====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR PANDEY ORAL ORDER 23-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner is apprehending his arrest in connection with Sasaram Town P.S. Case No. 994 of 2023 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 427, 379, 504, 506, 354 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per prosecution case, 60-70 accused persons including the petitioner armed with weapon, arrived at the door informant's house and while abusing, they attacked the informant and others. It is alleged that co-accused Manu Kumar and Nitish Kumar started abusing the informant, his wife and two other women and they also started molesting the women and when the same was protested, co-accused Manu Kumar and
2/4 Nitish Kumar damaged the car and auto in question. It is further alleged that petitioner snatched gold chain weighing 2 bhar from the neck of informant's wife and co-accused Manu Kumar snatched the informant's wallet containing Rs. 6,000/- (in cash). It is further alleged that in the alleged occurrence, co-accused Nitish Kumar and Rahul Kumar entered in the house of the informant and stole the inverter and battery. It is further alleged that when near by people gathered, the accused persons fired from the country made pistol and threatened to kill the informant and his entire family members, if they filed case against the accused persons.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged in the FIR and he has falsely been implicated in this case. He further submits that from the perusal of FIR, it is crystal clear that wife of the informant is an elected Nigam Parshad and on account of political rivalry the petitioner has been falsely implicated in the present case. No incriminating article has been recovered from the possession of the petitioner. He further submits that on similar and identical allegation, co-accused Monu Kumar @ Manu Kumar and Rahul Kumar have already been granted anticipatory bail by the Co-ordinate bench of this
3/4 Court vide Cr. Misc. No. 47901 of 2024. He further submits that co-accused Sonu Kumar, Vikrant Kumar and Ashu Kumar @ Aashu Kumar have already been granted anticipatory bail by the Co-ordinate Bench of this Court vide Cr. Misc. No. 49449 of 2024 and on the principle of parity, petitioner also deserves anticipatory bail. Petitioner bears no criminal antecedent.
5. The learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner by submitting that petitioner is FIR named accused persons. Hence, petitioner cannot escape from the allegation made in FIR.

Considering the facts and circumstances of the case, keeping in view clean antecedent of petitioner, co-accused have already been granted anticipatory bail by the Co-ordinate Bench of this Court, argument advanced on behalf of both sides and also taking into consideration the material available on record, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram, Rohtas in connection with Sasaram Town P.S. Case No. 994 of 2023, subject to the
4/4 conditions as laid down under Section 438(2) of the Cr.P.C.
7. The application stands allowed.
