The president of Til Ganga Educational Trust, Pakadiya, West Champaran, has approached this Court seeking a direction upon the respondents to consider the request for grant of permanent affiliation of Sanskar Bharti School of Education, Pakadiya, West Champaran, an affiliated degree college of BRA

2/4 Bihar University, Muzaffarpur, duly run by the Trust in various subjects of Arts, Science and Commerce faculties as recommended by the Syndicate and Senate of the University on the basis of the inspection report submitted by the duly constituted Inspection Team. Direction has also been sought for upon the Vice Chancellor of the University to place the matter of approval for permanent affiliation of the school in question along with all the required documents to the competent authority, so that final decision may be taken.

Learned Advocate for the petitioner, submitted that the Secretary of the Trust made an application on 13.9.2022 to the Registrar/Inspector of the College (Arts and Commerce), BRA Bihar University, for affiliation of the proposed degree college under various subjects of Arts, Science and Commerce faculties and for which the prescribed fee has been deposited. Accordingly, the petitioner's school has been granted temporary affiliation. The said affiliation has also been approved for the academic session 2023-2026 and 2024-2027. On being satisfied that the school fulfill all the requisite paraphernalia, an application for permanent affiliation was also filed through online portal of the Higher Education Department giving all the details of land status, building, teaching and non-teaching staffs. On receipt of

3/4 the application, an Inspection Committee was duly constituted and after proper verification of the record and physical inspection, recommendation has been made in favour of the school. The matter was placed before the Senate and Syndicate and as per the instruction of the petitioner, positive recommendation has been made. The entire fact has been brought to the Additional Chief Secretary, Education Department, Government of Bihar through a letter dated 26.9.2025, but till date no final decision has been taken, compelling the petitioner to approach before this Court.

Mr. Bindhyachal Rai, learned Advocate for the University, submitted that the petitioner is the President of the Til Ganga Educational Trust; though the grievance is with regard to the permanent affiliation of Sanskar Bharti School of Education, which is being run by the Trust. It is further submitted that so far as the University is concerned, all the formalities have been completed and now it is for the State to take a final decision.

5. Having considered the submissions advanced and taking note of the grievance of the petitioner, instead of keeping the writ petition pending, it would be apt and proper to dispose off the writ petition with direction to the respondent no.2, the

4/4 Additional Chief Secretary, Education Department, Government of Bihar, Patna to take up the matter with regard to the permanent affiliation of the petitioner's school and take a final decision on the basis of the inspection report and the recommendation made by the University, preferably within a period of six weeks from the date of receipt/production of a copy of this order, in accordance with law.
