2. This application, for grant of regular bail, arises out of Mali Police Station Case No. 77 of 2023, registered for the offence punishable under Section 302/34 of the Indian Penal Code and Section 27 of Arms Act.

3. The prosecution case is that assailant of the deceased is Guddu @ Niranjan Yadav and the petitioners are are only members of unlawful assembly

4. Learned counsel for the petitioners submits that the petitioner No.1 and petitioner No.2 are in custody since 29.09.2023 and 14.10.2023 respectively.

5. Considering the aforesaid facts, this application is allowed.

6. Let the petitioner, above named, be released on bail after framing of charge if charge has not already been framed on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Aurangabad, in connection with Mali Police Station Case No. 77 of 2023.
