Petitioner is apprehending arrest in connection with Kahalgaon P.S. Case No. 337 of 2018 for the offence under sections 327, 409 and 420 of the Indian Penal Code and Section BMMC Rules 1972 and 6/8 BMRC Rules.

Learned counsel for the petitioner submits that name of the petitioner surfaced in the instant case on the confessional statement of co-accused Lalu Mandal.

Learned counsel submits that similarly circumstanced co-accused have been granted anticipatory bail by a coordinate bench of this court namely, Lalan Rai in Cr. Misc. No. 45659 of 2018 vide order dated 6.8.2018 and Ajay Mandal in Cr. Misc. No. 47723 of 2018 vide order dated 24.8.2018.

No.56544 of 2018(3) dt.08-10-2018 2/2 Considering the fact that name of the petitioner surfaced on the confessional statement of the co-accused as well as the fact that similarly circumstanced other co-accused have been granted anticipatory bail, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur, in connection with Kahalgaon P.S. Case No. 337 of 2018 subject to the condition as laid down under section 438(2) of the Cr.P.C. (Anil Kumar Upadhyay, J) Ravi/- U T
