Learned counsel for the petitioner submits that the petitioner has challenged the order dated 20.09.2019 passed by learned Munsif, Sitamarhi in Eviction Suit No. 03 of 2015, whereby and whereunder the learned trial court has rejected the petition of the plaintiff/petitioner for appointment of Survey Knowing Pleader Commissioner. However, the petitioner does not want to proceed in the matter for seeking relief as mentioned in paragraph 1 of the petition and confines his prayer only for early disposal of eviction suit which is of year 2015. Learned counsel further submits that the eviction suit is running at the
Patna High Court C.Misc. No.1739 of 2019(7) dt.24-09-2024 2/2 stage of evidence of defendants.
3. Learned counsel appearing on behalf of the respondents has no objection.
4. In the light of submission made on behalf of the parties, the learned trial court is directed to expedite the trial and conclude the same preferably within a period of three months from the date of receipt/production of a copy of this order without granting unnecessary adjournments to either of the parties, who are directed to cooperate in early disposal of the case.
5. With the aforesaid direction, the present petition stands disposed of.
