The petitioner seeks regular bail in connection with Motihari Town P.S. Case No. 435 of 2019, G.R. Case No. 4608 of 2019, registered for the offence punishable under Sections 379 and 411/34 of the Indian Penal Code.

The allegation in the present case is against three named accused persons having arrived at the shop of the informant and they are said to have fled away from his shop after taking out his mobile. It is further alleged that when the petitioner was arrested by the police, one motor-cycle was recovered from him and the petitioner could not produce any registration paper with regard to the same.

Patna High Court CR. MISC. No.78433 of 2019(2) dt.02-12-2019 2/2 The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. It is further submitted that the fact is that the stolen mobile has not been recovered from the possession of the petitioner and as far as the motorcycle is concerned, since there were two other persons who had fled away from the scene of the occurrence, the said motor-cycle could be theirs. Lastly it is submitted that the petitioner is having a clean antecedent and is languishing in custody since 27.06.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari in connection with Motihari Town P.S. Case No. 435 of 2019, G.R. Case No. 4608 of 2019. (Mohit Kumar Shah, J) BT/- U T
