The petitioners seek bail in a case registered for the offence punishable under Sections 304(B), 34 of the Indian Penal Code.

Petitioners, who happen to be father-in-law and

Patna High Court CR. MISC. No.76396 of 2019(2) dt.12-12-2019 2/3 brother-in-law respectively of the niece of the informant are said to have committed dowry death to his niece by strangulating her neck.

It is submitted by learned counsel for the petitioners that the petitioners have no concern with the aforesaid occurrence. They neither made any demand of dowry nor tormented the deceased nor strangulated her to death. As a matter of fact, deceased has committed suicide due to some differences with her husband. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. Petitioner has no criminal antecedent and has been languishing in custody since 24.09.2019. The husband of the deceased is in custody and similarly situated co-accused Vimla Yadav @ Bimla Devi has been enlarged on bail by co-ordinate Bench of this Court vide order dated 28.08.2019 passed in Cr. Misc. No.53950 of 2019.

Learned APP for the State opposed the bail petition.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional
