2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 96, 3(5) of the B.N.S.

3. The case of the prosecution, in short, is that, on 14.05.2025 at about 08:30 A.M., the minor daughter of the informant, namely, (x), aged about 17 years went to coaching but she did not return for a considerable moment then the informant and family members started searching her. During search, the informant came to know that the petitioner along with others has kidnapped his minor daughter.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.82968 of 2025(2) dt.10-12-2025 2/3 that the petitioner is innocent and has committed no offence. From perusal of the order of the learned trial Court, it is evident that the statement of the victim girl was recorded under Sections 180 of B.N.S.S., wherein she has stated that she was in love with the petitioner and she went to Kolkata and solemnized marriage with the petitioner on her own sweet will. It is further submitted that the age of the victim is just approaching 18 though she has not completed 18 years and it is a case of elopement. It has also been submitted that the petitioner has clean criminal antecedent as stated in para 3 of the bail petition. Moreover, the petitioner is languishing in judicial custody since 28.09.2025.

5. Learned counsel for the informant and learned APP appearing for the State have vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kahalgaon P.S. Case No. 158 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Court of

Patna High Court CR. MISC. No.82968 of 2025(2) dt.10-12-2025 3/3 POCSO-cum-District and Additional Sessions Judge-7th, Bhagalpur/concerned Court below.
