Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner, who is in custody, seeks bail in a case registered for the offence punishable under Sections 21(C),23(C) of the Narcotics Drugs and Psychotropic Substance Act.

Earlier prayer for bail of the petitioner has been twice rejected by this Court vide Cr. Misc. No. 3012 of 2018 dated 09.02.2018 and vide Cr. Misc. No. 53154 of 2018 dated 12.10.2018 with a direction to the trial court to conclude the trial within one year.

Patna High Court CR. MISC. No. 79894 of 2019(3) dt.12-06-2020 2/2 Allegation against petitioner is of recovery of 6.1 Kg of Charas from the bag of the petitioner.

It has been submitted on behalf of petitioner that he is innocent and has been falsely implicated in this case on the basis of suspicion. Petitioner was pillion rider of the said bike and the other accused who was driving the bike fled away. Petitioner has no criminal antecedent and is in custody since 26.12.2016.

Report was called with respect to stage of trial and it is stated in the report that trial is likely to conclude within two months, as such, let the trial be concluded at the earliest. (S. Kumar, J) veena/rajivU T
