Petitioners seek bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 504, 307, 427 of the Indian Penal Code and Section 27 of the Arms Act.

There is case and counter case.

Submission is that allegation of firing and causing injury to Fahim Khan is against co-accused Sugga Bind and Rajesh Bind. However, the Doctor has not found any firearm injury on the person of Fahim. Other petitioners allegedly assaulted to some other persons.

Considering the nature of allegation and material

Patna High Court CR. MISC. No.78799 of 2019(2) dt.04-12-2019 2/2 available on the record, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Durgawati Police Station Case No. 266 of 2019, subject to the following conditions:- (a) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioners.

(b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
