JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2020 Petitioner seeks bail in connection with Kuchaikote P.S. Case No. 235 of 2019, registered for the offences punishable under Sections 341, 323, 324, 307, 504, 506 of the Indian Penal Code and Sections 25(1-B)(a), 26(r) and 27 of the Arms Act.

Prosecution case is that two persons came on motorcycle and after some talk with the informant they fuired at him, causing injury. It also appears that one accused told the informant that one Guddu Ansari has been given Supari for killing the informant and for that he has taken Rs.1.5 lac and it further appears that there was dispute with respect to allotment of bond between three partners.

Submission of learned counsel for the petitioner is

No.77124 of 2019(3) dt.06-03-2020 2/2 that except suspicion on the ground of threatening there is no other circumstance against him and he is in custody for six months and it is also submitted that in other case petitioner was witnesses to that case and petitioner has already been exonerated by police and no charge sheet has been submitted by police against him, as such there was no occasion for him to kill the informant.

Heard learned APP and learned counsel for the informant, who has opposed the prayer for bail stating that petitioner is king pin of the case and at his instance occurrence took place and another occurrence also took place at his instance in which one witness has been killed.

In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VII, Gopalganj, in connection with Kuchaikote P.S. Case No. 235 of 2019.
