The petitioner is the Branch Manager of Corporation Bank, Digha Ashiyana Branch and is seeking anticipatory bail in connection with Shashtrinagar P. S. Case No. 195 of 2018 registered for the offences punishable under Sections 191, 192, 419, 420, 468, 474, 476, 406, 120B of the Indian Penal Code. Learned counsel for the petitioner submits that in fact a perusal of first information report itself would show that the thrust of allegations are against one Mannu Kumar who is said to have taken the informant to the Bank. It is that Mannu Kumar who filled up the cheques and got the signature of the informant. The informant admits that she had got a loan amount of Rs. 5
Patna High Court Cr.Misc. No.59309 of 2018(6) dt.21-01-2019 2/3 lakhs from Veterinary College Branch of S.B.I. and she was paying the E.M.I. through said Mannu Kumar.
Learned counsel submits that the implication of this petitioner in the present case is a false and concocted implication. It is further pointed out that the informant has entered into a compromise with co-accused Chandan @ Kumar Virbahore an and Mannu Kumar @ Manoj and by virtue of the said compromise they have been granted anticipatory bail by learned Additional Sessions Judge VIII, Patna in A.B.P. No. 6442 of 2018.
Learned counsel for the State is present and opposed the application for grant of anticipatory bail. The facts remains that the co-accused Mannu Kumar against whom there were allegations of taking signature of informant on the cheques and was being entrusted with the money by the informant to deposit the money has already been granted anticipatory bail by the court below. In the facts and circumstances as stated above, the petitioner above named, in case of his arrest or surrender within a period of four weeks from today, is directed to be released on bail on execution of bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of

Case No. 195 of 2018, subject to the condition that the petitioner will join the investigation by reporting the Investigating Officer within a period of two weeks from today and further subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
