2. Petitioner apprehends their arrest in a case registered for the offence punishable under sections 147, 148 , 149, 323 , 341 , 504 and 302 of the Indian Penal Code and 25 (1-b)/a/26/35 of Arms Act.
3 . As per the prosecution case , informant alleged that in the evening of 21.06.2024 all the accused persons including this petitioner armed variously came at the door of informant and thereafter it is alleged that upon exhortation made by the accused persons, Kaushal opened fire which hit the right chest of son of informant, Vishal Kumar. When the villagers assembled there, all the accused persons escaped. The injured was rushed to sadar hospital Ara where he was declared dead.

4. Learned counsel for the petitioner submits that he has falsely been implicated in this case because of property dispute for which series of litigations are pending between the parties.
5. Learned counsel for the Sate opposed the bail petition and submitted that there is specific accustion that this petitioner along with other co-accused persons opened fire upon husband of informant as a result of which he died. Petitioner has got 3 criminal antecedent.
6. Considering the nature of accusation , criminal antecedent and other circumstances of the case , prayer for pre - arrest bail of the petitioner is rejected.
