The petitioner seeks bail in Sabour P.S. Case No. 114/2016, S.T. No. 97/2017, instituted for the offences under Sections 302, 120(B) and 34 of the Indian Penal Code read with Section 27 of Arms Act.
It is alleged in the written report that while the informant and his uncle were coming on motorcycle, accused Taira Mandal opened fire on the back of his uncle due to which he fell down. Thereafter co-accused Taira Mandal and the petitioner made firing on the informant, which did not hit him. It is further alleged that Taira Mandal again caused two firearm injuries on the head of uncle of informant.
Patna High Court Cr.Misc. No.58046 of 2018 (3) dt.29-10-2018 2/2 Learned counsel for the petitioner has submitted that there is specific allegation of causing firearm injury to the uncle of informant against co-accused Taira Mandal. There is allegation against this petitioner that he along with Taira Mandal made firing on the informant, which did not hit the informant. Petitioner is in custody since 25.10.2016.
Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge Vth, Bhagalpur in connection with Sabour P.S. Case No. 114/2016, S.T. No. 97/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
