A raid was conducted by the informant, a police official, on getting confidential information regarding storage of wine in contravention of the Excise Act by Sampat Rai, Vimal Rai and Viveka Rai. At that very time all of them managed to escape. However, there happens to be joint seizure list relating to recovery of wine 5 bottles of Royal Challenger (each containing 750 ml.), McDowell Rum 21 pieces (each 180 ml.), 11 pouch country made wine (each 200 ml.), 26 pouch country made wine (each containing 200 ml.), 39 pouch of spirit (each 500 ml.), from the place of Viveka Rai 7 litres of Mahua wine, gas cylinder and gas stove equipment for preparation of Mahua

Patna High Court CR. MISC. No.78150 of 2019(2) dt.02-12-2019 2/2 wine and Mahua Jawa were seized, whereupon the petitioner surrendered on 21.10.2019 and is under custody since then having no criminal antecedent as per para-3 of the petition. Accordingly, the petitioner, Vimal Rai is directed to be released on bail on furnishing bail bond of Rs.10,000/ (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna in connection with Special Case No. 3199/2019 arising out of Athmalgola P.S.Case No. 52/2019.
