2. The petitioners seek bail in a case registered for the offence punishable under Sections 302 and 304B/34 of the Indian Penal Code.
3. The petitioners along with other co-accused is said to have killed the sister of the informant by hanging her.
4. It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place. They are quite innocent and have been falsely implicated in this case. Petitioners are father-in-law and mother-in-law of the deceased and are living separately with their son. They have no
Patna High Court CR. MISC. No.87685 of 2024(2) dt.29-01-2025 2/2 concern with the aforesaid occurrence. The husband of the deceased is already in judicial custody. The petitioners have no criminal antecedent and have been languishing in custody since 01.10.2024.
5. Learned APP for the State opposed the bail petition.
6. Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Chiraiya P.S. Case No.84 of 2024, subject to the condition that the petitioners shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, their bail bonds shall be liable to be cancelled by the learned court concerned.
