====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 10-10-2018 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in connection with Sikandara P.S. Case No. 143 of 1991 registered for the offence punishable under sections 420, 465, 467, 468 and 409 of the Indian Penal Code.

Petitioner has earlier moved this court for grant of bail in Criminal Misc. No. 17036 of 1995 which was dismissed as withdrawn vide order dated 13.11.1995 (Annexure-1). Learned counsel appearing for the petitioner submits that petitioner has not committed any offence, rather he has been falsely implicated in the present case due to dirty village politics. Nothing specific has been alleged against this

Patna High Court Cr.Misc. No.57598 of 2018(2) dt.10-10-2018 2/2 petitioner. The only allegation is that petitioner and other coaccused persons has misappropriated the government fund amounting to Rs. 80,000/- but there is no material to support the allegations. Learned counsel further submits that petitioner is ready to deposit the amount in question.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties specially the undertaking given by the petitioner, in case petitioner deposits an amount of Rs. 1,00,000/- (one lacs) in the court below which shall be subject to the final outcome of the case, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Jamui in connection with Sikandara P.S. Case No. 143 of 1991 subject to the conditions laid down under section 438(2) Cr.P.C.
