The petitioner seeks regular bail in connection with Wazirganj P.S. Case No. 168 of 2019 for the offence registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 22 liters of illicit liquor from nearby a pond and subsequently the villagers informed the Police that the same belongs to the petitioner herein and on mere suspicion, the petitioner is stated to have been arrested.

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case and he is having a clean antecedent. It is further submitted

Patna High Court CR. MISC. No.76451 of 2019(2) dt.04-12-2019 2/2 that no recovery of illicit liquor has been made from the petitioner. Lastly, it is submitted that the petitioner is languishing in custody since 15.07.2019.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya in connection with Wazirganj P.S. Case No. 168 of 2019.
