1. Heard learned Counsel for the petitioner and learned APP for the State.
2. This application, for grant of anticipatory bail, arises out of Dhangai P.S. Case No. 41 of 2023, disclosing offences punishable under Section 392 of the Indian Penal Code.
3. As per the First Information Report, on 25.04.2023, while the informant, who was a courier boy in Ecom Express, reached near Bihari Jee Temple, three persons, on black coloured Pulser stopped him and asked him about the courier of Suraj, to which the informant denied. In the meanwhile, one accused person pointed pistol upon him and two other persons

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has not committed any offence in the manner alleged. He further submits that he is not named in the FIR and his name transpired in the present case on the basis of confessional statements of co-accused, Manish Rider and Akshay Kumar Yadav
5. I have heard learned Counsel for the parties concerned and have perused the material available on record, including the impugned order.
6. From perusal of the impugned order, it transpires that co-accused Manish Rider and Akshay Kumar Yadav, in their confessional statements, disclosed the active involvement of the petitioner in the alleged offence. Petitioner is having three criminal antecedent of similar nature of offence.
7. Considering the above, I do not find any reason to differ with the findings arrived at by the 2nd Additional Sessions Judge, Bhojpur at Ara, inasmuch as the case in under investigation, wherein the custodial interrogation of the petitioner may be necessary based upon the material collected by the police during course of investigation. As such, I am not inclined to grant anticipatory bail to the petitioner.
