JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 This is an application for grant of anticipatory bail in connection with Sarai P. S. Case No. 186 of 2019, disclosing offences under Sections 341, 323, 498A and 304B of IPC and Section 3⁄4 of D.P. Act.

Petitioner happens to be the husband of the complainant. There is allegation of demand of rupees one lakh and setting her on fire.

Submission of the learned counsel for the petitioner is that the F.I.R. itself disclosed that petitioner and other family members taken her to the hospital and also PMCH, but she died. As a matter of fact, she caught fire while preparing the food. Heard learned A.P.P. also.

Having heard both sides, in view of the allegations, I am not inclined to grant privilege of anticipatory bail to the

Patna High Court CR. MISC. No.77006 of 2019(2) dt.20-01-2020 2/2 petitioner. However, he has to surrender before the learned court below and make prayer for regular bail, the same shall be considered on its own merit, without being prejudiced by this order.
