The petitioner seeks bail in a case registered for the offence punishable under Sections 401, 379, 414, 427, 420/34 of the Indian Penal Code and 66 (A) of I.T. Act 2000. Allegation is that one electronic machine and three A.T.M. Cards and two mobiles are recovered.

Learned counsel for the petitioner submits that the petitioner is in custody since 24.08.2019. Chargesheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely implicated in the present case. No wrongful gain has been made on the part of the petitioner nor any wrongful loss has been caused to the Bank in question. No incriminating

Patna High Court CR. MISC. No.78057 of 2019(2) dt.04-12-2019 2/2 article is said to have been recovered from the passessions of the petitioner except small electronic parts, who has no relevance in respect of the present case.

Counsel for the petitioner submits that similarly situated co-accused has already been granted bail by co-ordinate Bench of the Court vide order dated 14.11.2019 passed in Cr. Misc. No. 63076 of 2019.

In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in connection with Sheikhpura P.S. Case No. 346/2019.
