This application for regular bail arises out of Excise Case No. 373 of 2019, disclosing the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

The petitioner is in custody since 25.10.2019. It has been stated in paragraph 3 of the application that he does not have a criminal antecedent. It is alleged that from a hut belonging to the petitioner the excise officials recovered 20 litres of country-made liquor.

Learned Senior Counsel appearing on behalf of the petitioner has submitted that the place from where the recovery has been made does not belong to the petitioner.

Patna High Court CR. MISC. No.78529 of 2019(2) dt.10-01-2020 2/2 Considering the facts and circumstances and quantity of illicit liquor alleged to have been recovered, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned ADJ-II cum Special Judge, Excise, Gopalganj in Excise Case No. 373 of 2019.

This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
