JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-02-2024 The present writ petition has been filed seeking the following relief:- "1. That the petitioner in the instant writ application prays for a direction to the Respondent authority to grant promotion on the post of Upper Division Clerk (in Pay Scale Level-4) from the Office Attendant on the basis of level jumping in the light of Notification No. 19300 dated 13.10.2023 issued by the General Administration
Patna High Court CWJC No.742 of 2024(5) dt.29-02-2024 2/3 Department Government of Bihar Patna and the petitioner also prays for a direction to the Respondent Authority to grant the charge of post of Upper Division Clerk in the pay scale level-4 including pay scale in the light of Notification No.
19300 dated 13.10.2023 issued by the General Administration Department Government of Bihar Patna as the similarly situated employee of the Government of Bihar has been already granted the said benefit of promotion on the basis of level jumping as well as charge of higher post including the pay scale and the petitioner also prays for a direction to the Respondent authority to follow the provision of Bihar State Litigation Policy as well as in the light of judgment passed in the case of 2008(4) PLJR 125 and 2011(3) PLJR 588 & (2006)2 SCC 747 by the Hon'ble Courts and grant same benefit which has been granted other similarly situated employee in the light of provision of Notification No. 19300 dated 13.10.2023 issued by the General Administration Department,

After some arguments, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Additional Chief Secretary, Revenue and Land Reforms Department, Government of Bihar, Patna i.e. the respondent no. 2 for redressal of his aforesaid grievances. Liberty, so sought, is granted.

It is needless to state that in case the petitioner approaches the Additional Chief Secretary, Revenue and Land Reforms Department, Government of Bihar, Patna i.e. the respondent no. 2, by filing appropriate representation, within a period of two weeks from today, the same shall be disposed off by a reasoned and a speaking order, in accordance with law, within a period of six weeks, thereafter.

The writ petition stands disposed off on the aforesaid terms.
