====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-12-2019 Petitioner seeks bail in connection with Chapra (T) P.S. Case No. 446 of 2019 registered for the offences punishable under Section 376 D/34 I.P.C and Sections 4, 5, 5(G) and 6 of POCSO Act.
As per F.I.R., allegation against the petitioner and other co-accused of committing rape upon the minor daughter of the informant.
Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case due to village politics. He is in custody for about three months. He is ready to abide by any condition imposed upon him.
On the other hand learned A.P.P. who has opposed the prayer for bail on the ground that there is a gang rape and the
Patna High Court CR. MISC. No.78328 of 2019(2) dt.03-12-2019 2/2 victim girl is minor.
Having heard both sides, in view of the allegations, I am not inclined to grant privilege of bail to the petitioner. With the aforesaid, this application is dismissed. (Vinod Kumar Sinha, J) Rahul Mishra/- U T
