The petitioner seeks bail in Dhamdaha P.S. Case No.280 of 2019 registered under Sections 457, 380 and 411 of the Indian Penal Code.
The informant suspected that Kittu Mahto committed theft of his motorcycle. During the course of investigation, Kittu Mahto was apprehended and he is said to have disclosed before the police that the petitioner and others also participated in theft of the motorcycle.
The learned counsel for the petitioner submits that save and except the statement of Kittu Mahto, there is no other tangible material against the petitioner. Petitioner is in jail since 06.09.2019 and petitioner has not been put on T.I.P. It is further submitted that petitioner although has got criminal antecedent
Patna High Court CR. MISC. No.77154 of 2019(3) dt.16-03-2020 2/2 and two cases are pending but for no fault on the part of the petitioner, petitioner is in jail for more than six months. Considering the fact that name of the petitioner figured in the case in the confessional statement of co-accused and for that petitioner has remained in jail for more than six months, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Dhamdaha P.S. Case No.280 of 2019.
