The petitioner is languishing in custody for the offences punishable under Sections 120B/399/402 of the Indian Penal Code, Section 25(1-b)a/26/35 of the Arms Act, Section 30(a) of the Bihar Prohibition and Excise Act, 2016, and Section 17 of the C.L. A. Act.

Allegation is that the petitioner was one of the member of the naxal group, who had fled away from the place of arrest of other co-accused from whose possession fire-arm was recovered.

Submission is that the petitioner is in custody since 19.06.2018. Investigation of the case is already complete.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Roshanganj P.S. Case No.24 of 2018, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
