2. The petitioner has preferred this application for grant of regular bail in connection with Tedhagachh P.S. Case No. 74 of 2024 dated 08.08.2024 registered for the offences punishable under Sections 80(2) read with Section 3(5) of B.N.S.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have hanged the informant's daughter to death due to non-fulfillment of demand of dowry.

4. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. The name of the petitioner has transpired in this case on mere suspicion. There is general and omnibus allegation against the

Patna High Court CR. MISC. No.85948 of 2024(3) dt.12-05-2025 2/2 petitioner who is the husband of the deceased. The petitioner neither demanded any dowry nor tortured the informant's daughter. The petitioner has no concern with the alleged offence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 09.08.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that as per the post-mortem report of the deceased, the cause of death is due to Asphyxia and shock as a result of hanging.

6. Considering the aforesaid facts and circumstances of the case as well as the heinous nature of offence against the petitioner, this court is not inclined to grant bail to the petitioner and the same is rejected in connection with Tedhagachh P.S. Case No. 74 of 2024, pending in the Court of learned Judicial Magistrate-1st Class, Kishanganj.

7. Learned court below is directed to conclude the trial of the appellant at the earliest.

8. The application stands rejected.
