Mr.Anil Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 29-05-2020 Heard the parties through the virtual court proceeding. The petitioner seeks bail in connection with Mansi P.S. Case No. 44 of 2018/ S.Tr. No.-230 of 2018 corresponding to G.R. No.562 of 2018 registered for the offence punishable under Section 364/34 of the Indian Penal Code. Learned counsel for the petitioner submits that this case has been lodged by wife of the deceased against her son and daughter-in-law. In the written report, it is alleged that the husband of the informant had gone to perform Puja in the house of Shankar Yadav in village Tokapur and did not return. From the impugned order, it appears that dead body of the husband of the informant was recovered from maize field as is evident from paragraph-12 of the case diary. Informant has raised suspicion against the petitioner because he had given

Learned counsel for the petitioner further submits that similarly situated co-accused has been granted bail vide order dated 05.09.2018 passed in Cr. Misc. No.40334 of 2018. He further submits that another similarly situated co-accused has been granted anticipatory bail vide order dated 10.08.2018 passed in Cr. Misc. No.39192 of 2018. The case diary of the petitioner is similar to the other accused persons, which have been granted bail by this Co-ordinate Bench of this Court. Petitioner is in jail custody since 16.02.2019.

In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of Uma Shankar Dwividi, Sessions Judge, Khagaria in connection with Mansi P.S. Case No. 44 of 2018/ S.Tr. No.-230 of 2018 corresponding to G.R. No.-562 of 2018.
