====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 21-03-2024 Heard learned counsel for the petitioners and learned counsel for the State.
2. Petitioners apprehend arrest in connection with Motihari Town P.S. Case No. 564 of 2023 registered for the offences under Sections 447, 448, 341, 385, 353 and 34 of the Indian Penal Code.
3. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the instant case. Further submission is that the F.I.R. has been lodged after five months of the alleged occurrence without any
Patna High Court CR. MISC. No.12593 of 2024(2) dt.21-03-2024 2/2 explanation for the said delay. It is further submitted the petitioners have questioned the misappropriation of the fund of Ambedkar Welfare Committee by the opposite party as contained at Annexure-2 & 3 of the petition and this FIR has been lodged against the petitioners in the backdrop of vengeance and to settle scores with the petitioners. The petitioners have no criminal history.
4. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioners, above named are directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of C.J.M., East Champaran, Motihari in connection with Motihari Town P.S. Case No. 564 of 2023, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
