JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-03-2020 The petitioner, who is the father-in-law of the deceased seeks bail in connection with Chautham P.S. Case No. 151 of 2019 corresponding to G.R. No. 2048 of 2019, dated 17.07.2019, instituted for the offence under Sections 201, 302 read with 34 of the Indian Penal Code.

The petitioner is in custody since 24.07.2019.

The father of the deceased has lodged the First Information Report alleging that because of the deceased having spotted her husband indulging in an amorous relationship with any neighbour, she was tortured.

Patna High Court CR. MISC. No.78434 of 2019(3) dt.17-03-2020 2/2 Ultimately, it has been alleged that the deceased was killed at the hands of her husband and other relatives.

The petitioner is the father-in-law of the deceased. There is practically no accusation against him in the First Information Report and the allegations against the entire family is based on surmises and conjectures.

Considering the nature of accusation against the petitioner and also taking into account the fact that the husband of the deceased is in custody, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sri. Satish Mani Tripathi, Judicial Magistrate, Khagaria in connection with Chautham P.S. Case No. 151 of 2019 corresponding to G.R. No. 2048 of 2019.

The application stands allowed.
