2. The petitioner seeks pre-arrest bail in connection with Jogapatti P.S.Case No.407 of 2025, registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act.

3. As per the allegation made in the FIR, the police seized total 59.220 ltrs. of India made foreign liquor from a motorcycle.

4. From perusal of the record, it appears that altogether 59.220 ltrs. of Indian made foreign liquor was recovered from a Motorcycle bearing Registration No.BR05AT 3512 but the petitioner has not been arrested at the spot and his

In paragraph no.3 of the bail application, it has been mentioned that the petitioner is involved in three cases of similar nature and he is on bail in those cases.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

6. Considering the rampant sale, manufacturing and smuggling of the liquor and no action having been taken against the smugglers and the kingpin, as well as, the petitioner has three criminal cases of similar nature, in which he is on bail, the petitioner is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the district court within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court II, West Champaran at Bettiah in connection with Jogapatti P.S.Case No.407 of 2025, subject to the conditions as laid down under Section 438(2) of the Cr.P.C./Section 482(2) of BNSS.

7. The learned district court is directed to verify the criminal antecedent of the petitioner and if it is found that the petitioner is involved in some other cases as what has been
