2. The petitioners seek regular bail in connection with Nautan P.S. Case No. 164 of 2023 registered for the offence under Sections 304B/34 of the Indian Penal Code.
3. The prosecution case, in brief, is that the petitioners along with others used to torture and assault the informant's daughter due to non-fulfillment of dowry demand. It is further alleged that on 4.8.2023, the informant came to know that is daughter was assaulted by the accused persons due to which she consumed poison and admitted in hospital. Thereafter, she died during treatment.
4. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.7454 of 2024(2) dt.17-02-2024 2/2 petitioners are innocent and have committed no offence. The petitioners are father-in-law & mother-in-law of the deceased due to which they have falsely been implicated in the present case. The petitioners have no concern mess and business of the deceased as well as her husband and live separately from them. It is also submitted that the deceased herself consumed poison due to quarrel with her husband. No specific allegation against these petitioners. They have got no criminal antecedent and languishing in judicial custody since 25.8.2023. 5.Learned APP appearing for the state has opposed the prayer of regular bail.
6. Considering the facts and circumstances of the case as well as custody period of the petitioners, this court is inclined to enlarge them on bail. The above named petitioners are directed to be released on bail in connection with Nautan P.S. Case No. 164 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Siwan.
