The petitioner wants payment of admitted due to the tune of Rs. 77,97,856/- against the supply of C.M.R. rice pursuant to the agreement between the petitioner- PACS, Induat Panchayat, Hilsa, Nalanda with the respondent no. 3 the Managing Director, Bihar State Food Corporation Ltd., Patna). On 03.07.2023, the matter was adjourned with a

Patna High Court CWJC No.25514 of 2019(4) dt.31-07-2023 2/2 direction to the respondent for file counter affidavit. Today on call, no counter affidavit has been filed. In that view of the matter, keeping the writ petition pending has got no meaning.

As no such counter affidavit has been filed, the writ petition stands disposed of with a direction to the petitioner appear to file a comprehensive representation before the respondent no. 3 within four weeks.

If such representation is preferred before the respondent no. 3 shall consider the representation of the petitioner within a period of three months three months thereafter.
