2. The petitioners are apprehending their arrest in connection with Hajipur Town P.S Case No. 461 of 2024 dated 28.06.2024 registered for the offence punishable u/s 366A read with Section 34 of the I.P.C.

3. As per prosecution case, the petitioner and the coaccused person are alleged to have kidnapped the minor daughter of the informant.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The victim in her statement recorded u/s 164 of the Cr.P.C. has not taken the name of the petitioners in the alleged crime and she has also stated that she went to Patna on account of

Patna High Court CR. MISC. No.86652 of 2024(3) dt.10-10-2025 2/2 assaulting by her father. The petitioners have no concern with the alleged offence. The petitioners have no criminal antecedent as stated in para 3 of the bail petition.

5. Learned APP for the State has vehemently opposed the prayer for anticipatory bail of the petitioners.

6. Considering the aforesaid facts and circumstances of the case as well as the nature of allegation against the petitioners, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned court concerned, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 461 of 2024, subject to conditions as laid down under Section 482(2) of the B.N.S.S.

7. The application stands allowed.
