Petitioner, who is in custody, seeks bail in a case, registered for the offence punishable under Sections 363, 366(A), 376(D), 372, 506 and 34 of the Indian Penal Code and Sections 4 and 6 of the POCSO Act.

Allegation against the petitioner is to have committed rape on minor daughter of the informant.

It has been submitted on behalf of the petitioner that the petitioner is innocent and he has been falsely implicated in this case. The petitioner has no criminal antecedent and he is in custody since 02.04.2019.

Out of 8 prosecution witnesses, 6 witnesses have already been examined and only two witnesses, I.O. and Doctor

Patna High Court CR. MISC. No.77553 of 2019(2) dt.28-11-2019 2/2 is to be examined. As such, I am not inclined to release petitioner on bail at this stage.

The trial court is directed to conclude the trial within three months from the date of receipt/production of a copy of this order.
