The petitioner, on being aggrieved with the inaction of the respondent in not extending the arrears of salary in terms with pay verification certificate duly issued by the State Government has approached this Court seeking a direction upon the respondent University to pay the arrears of salary as per Pay Verification Cell for the period April 1981 to Feb, 1998, which

Patna High Court CWJC No.19275 of 2025(2) dt.01-12-2025 2/3 comes to Rs. 1,19,162/- and further for the period April to March 2017, which comes to Rs. 9,77,311/- and thereby total comes to Rs. 10,96,473/-.

Learned Advocate for the petitioner submitted that on being appointed as an Assistant in Nalanda College, Bihar Sharif, the petitioner satisfactorily completed his service tenure and finally superannuated from his service with effect from 31.08.2016. After superannuation the pension payment order no. 5019/2017 issued and accordingly all the pensionary benefits have been paid. The service record was duly verified at the level of the Pay Verification Cell constituted by the State Government and thereupon a Pay Verification Certificate has been issued in favour of the petitioner. However, the arrears of difference of salary as per Pay Verification Certificate has not been paid to the petitioner; although two bills, first from 1981 to February, 1998 and second from April, 1997 to March, 2017, the total of which comes to Rs. 10,96,473/- have been sent by the Principal of the college to the Registrar, Finance Officer, Magadh University, Bodh Gaya way back on 03.08.2024, but the said amount has not been paid to the petitioner. Hence the present writ petition.

4. Learned Advocate for the Magadh University submits that initially the petitioner was serving under the

Be that as it may, considering the nature of the grievance and the fact that the Principal of college concerned has already submitted bill for arrears of difference of salary as par with Pay Verification Certificate, the copy of which is placed on record as Annexure P/3. This Court thinks it apt and proper to dispose off the writ petition with a direction to the Registrar, Magadh University as well as the Finance Officer of Magadh University, Bodh Gaya to look into the matter and ensure payment of all the admissible amount of arrears of difference of salary of the petitioner, in terms with the Pay Verification Certificate issued by the State Government, preferably within a period of ten weeks' from the date of receipt/production of a copy of this order.

6. Suffice it to observe that the State Government shall cooperate in providing the appropriate fund.

7. The writ petition stands disposed off.
