2. The petitioner apprehends his arrest in connection with Nautan P.S. Case No. 208 of 2024, registered for the offences punishable under Sections 363, 364A, 506/34 of IPC and u/s 8 of POCSO Act and u/s 3(2)(v) of SC/ST (POA) Act.

3. As per allegation, the petitioner took away the victim on his motorcycle. When the informant went to his house, all the FIR named accused persons abused him by calling his caste name and also threatened to kill him.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. The victim did not support the case in her statement recorded under

Patna High Court CR. MISC. No.85883 of 2024(6) dt.18-11-2025 2/2 Section 183 of the BNSS. She has stated that she solemnized marriage with the petitioner according to her own sweet will. He has submitted further that presently, the petitioner and the victim are residing as husband and wife and they have been blessed with a child.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail provisionally for three months on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO cum ADJ VI, West Champaran, Bettiah in connection with Nautan P.S. Case No. 208 of 2024, subject to the conditions as laid down under Section 438(2) Cr.P.C.

6. In the meantime, the learned court below shall call the petitioner and the victim to personally appear and report, and if it is found that they have solemnized marriage according to sweet will of the victim, the bail bond shall be confirmed.
