JUSTICE BIRENDRA KUMAR ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is languishing in custody for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
The FIR of the occurrence of murder is against unknown. Name of the petitioner surfaced in the confessional statement of co-accused Deepak Kumar. The impugned order does not reveal any other material against the petitioner. Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with N.H. Bangra P.S. Case No.94 of 2017, with following conditions:
Patna High Court Cr.Misc. No.57236 of 2018 (2) dt.20-09-2018 P2/ (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
