JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2020 The petitioner seeks regular bail in connection with Tekari P.S. Case No. 210 of 2019, registered for offences punishable under Sections 406, 420 and 379 of the Indian Penal Code.

As per prosecution case, the Informant went along with one co-accused Raushan Kumar to withdraw the alleged amount from ATM. He has handed him the ATM Card and it is alleged that the co-accused Raushan Kumar has exchanged the ATM Card and in between 01.06.2019 to 25.06.2019 he withdrew altogether Rs. 7, 00,000/- (Seven Lakhs) in cash or through E-purchase. It further appears that one of the cellphone has been purchased in the name of the petitioner by using ATM card and mobile was recovered from him.

Submission of learned counsel for the petitioner is

Patna High Court CR. MISC. No.83998 of 2019(3) dt.27-02-2020 2/2 that even according to FIR the main accused is Raushan Kumar who has been granted bail by a Co-ordinate Bench of this Court vide order dated 04.12.2019 passed in Cr. Misc. No. 63456 of 2019. Further, the petitioner has been in judicial custody since 05.08.2019.

Heard learned A.P.P. who has opposed the prayer for bail.

Having heard both sides, in view of the above submissions, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Gaya in connection with Tekari P.S. Case No. 210 of 2019.
