This application for grant of regular bail arises out of Banka (Mahila) P.S. Case No.69 of 2018 registered for the offence punishable under Section 376(D) of the Indian Penal Code.

There are two persons named in the First Information Report including this petitioner, who are said to have committed forcible sexual assault on the victim. Learned counsel appearing on behalf of the petitioner has submitted, referring to an order of this Court dated 23.04.2019 passed in Cr. Misc. No. 26255 of 2019, that another co-accused Anil Yadav has been granted regular bail by this Court after considering the submission that the accusation was mistake of fact.
