2. The petitioner is apprehending his arrest in connection with Jokihat P.S. Case No. 463 of 2023, F.I.R. dated 29.09.2023 for the offences punishable under Sections 21(b) and 21(c) of the N.D.P.S. Act.

3. According to prosecution case, 80 litres of Eskuf cough syrup was recovered from the house of the petitioner.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offence as alleged in the F.I.R.

Patna High Court CR. MISC. No.740 of 2024(3) dt.09-04-2024 2/2 He further submits that the petitioner has been made accused in the present case merely on the basis of the confessional statement of the co-accused person, namely, Md. Alam.

5. Learned Additional Public Prosecutor for the State, on the other hand, has vehemently opposes the prayer of the bail of the petitioner and submits that 80 litres of Eskuf cough syrup was recovered from the house of the petitioner.

6. Considering the aforesaid facts, the recovery of Eskuf cough syrup is made from the house of the petitioner, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Jokihat P.S. Case No. 463 of 2023 pending in the court of learned Sessions Judge, Araria.

7. Prayer is refused.
