JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-12-2019 This modification application has been filed for modification of order dated 22.10.2019 passed in Cr. Misc No.66705 of 2019, in which the regular bail was granted to the petitioner but by mistake the order has been passed showing 'anticipatory bail'.

Heard learned APP as well as perused the order dated 22.10.2019 and also perused the petition of Cr. Misc No.66705 of 2019, from which it appears that it is a regular bail application but by mistake the office has mentioned as 'anticipatory bail application' in the title page. Considering the same, first paragraph of order dated 22.10.2019 is modified to the extent that the word 'anticipatory

No.79228 of 2019(2) dt.13-12-2019 2/2 bail' be read as 'regular bail' and the last paragraph of the order dated 22.10.2019 is modified to the extent that the words 'in the event of his arrest or surrender before the court below within six weeks' be deleted from the above order and in the last line 'Section 438(2) of the Code of Criminal Procedure be read as Section 439 of the Code of Criminal Procedure and others part of the order shall remain intact.

Let a copy of this modification order be communicated to the learned court concerned at once.

Accordingly, this modification application is allowed.
