JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 This application, for grant of anticipatory bail, arises out of Piprahi P.S. Case No. 154 of 2018, disclosing offences under Sections 363, 366(A)/34 of the Indian Penal Code.

Allegation is of kidnapping the minor daughter of informant and it further appears from impugned order that the girl is still traceless.

Submission of learned counsel for the petitioner is that the girl has fled away with one Md. Shakir @ Pappu and petitioner has falsely been implicated in this case. Further submission is that petitioner is aged about 60 years having no criminal antecedent.

Having heard both sides, considering the facts and

No.76869 of 2019(2) dt.20-01-2020 2/2 circumstances of the case, though, I am not inclined to grant the privilege of anticipatory bail, however, if the petitioner surrenders in the court below and make prayer for regular bail, the same will be disposed of by the court below on the basis of materials available on record, if possible on same day, without being prejudiced by this order.
