JUSTICE ARUN KUMAR JHA ORAL ORDER 03-12-2025 Both the criminal miscellaneous petitions have arisen out of the same police station case number, hence they are being heard together and decided by a common order.
2. Heard learned counsel for the petitioners and learned A.P.P. for the State.

3. In the present case, the petitioners seek bail in connection with Sangrampur P.S. Case No. 130 of 2025 dated 07.08.2025, registered for the offences punishable under Sections 191(2), 190, 109, 119(1), 308(2), 308(5), 308(4), 352, 351(2) and 191(3) of the B.N.S., 2023 and under Section 27 of the Arms Act.

As per the prosecution case, when the informant went to his land for getting it ploughed by tractor, the petitioners and other co-accused persons armed with lathi and fire-arms came to the said land and started hurling filthy abuses. They also told the informant to withdraw the case running in Munger Court within three days and also demanded rupees four lakhs as extortion money. Further allegation is that co-accused Uday Yadav and petitioner Sachin Kumar fired upon the informant, who somehow saved himself after running away from his field. Thereafter, the accused persons forcibly ploughed the land of the informant.
5. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and they have falsely been implicated in the present case and they have not committed any offence. The FIR has been lodged after delay of three days, but there is no plausible explanation for the said
3/4 delay. Learned counsel further submits that there is land dispute between the parties and this the reason for false implication. There is no specific allegation against the petitioners and no injury report has been brought on record. Learned counsel next submits that petitioner Sachin Kumar is having antecedent of one case in which he is on bail and petitioner Subodh Yadav @ Bhutoo Yadav is having antecedent of two cases and he is on bail in both the cases while petitioner Guddu Yadav @ Gudan Yadav is having clean antecedent. Learned counsel lastly submits that petitioner in Cr. Misc. No. 82003 of 2025 is in custody since 28.08.2025 and petitioners in Cr. Misc. No. 82422 of 2025 are in custody since 08.08.2025 and chargesheet has been submitted on 22.10.2025.
6. Learned A.P.P. appearing on behalf of the State opposes the submission made on behalf of the petitioners.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the general and omnibus nature of allegation and further considering the fact of no harm coming to any person and also considering period of custody of the petitioners and submission of chargesheet, the petitioners, above-named, are directed to be released on bail, on furnishing bail bonds of Rs.10,000/-
4/4 (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Munger / concerned Court, in connection with Sangrampur P.S. Case No. 130 of 2025, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions:
(i) One of the bailors will be a close relative of the petitioners.
(ii) The petitioners will remain present on each and every date fixed by the court below, if so required by the learned trial Court.
(iii) In case of non-appearance of the petitioners on single date or in violation of the terms of the bail, the bail bond of the petitioners will be liable to be cancelled by the Court concerned.
