The petitioner is languishing in custody for the offences punishable under Sections 461/379 of the Indian Penal Code.

Petitioner is in custody since 05.12.2018. The FIR of the occurrence of theft of vehicle is against unknown. Submission is that the vehicle was not recovered from the possession of the petitioner nor the petitioner was ever put on Test Identification Parade. Only on the basis of the criminal antecedent, the petitioner has been booked in this case. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like

Patna High Court CR. MISC. No.77497 of 2019(2) dt.28-11-2019 2/2 amount each to the satisfaction of the learned Court-below where the case is pending in connection with Araria P.S. Case No.571 of 2017, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
