The petitioner is languishing in custody since 04.10.2019 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It is alleged that the petitioner and one Md. Sajjad were apprehended while driving Hero Glamour motorcycle carrying 29.400 litres of Nepali Saufi liquor on that. It is submitted by learned counsel for the petitioner that only on the basis of suspicion, the petitioner has been roped in the present case and a statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

Patna High Court CR. MISC. No.77255 of 2019(2) dt.04-12-2019 2/2 Learned APP submits that the recovery has been made from the possession of the petitioner.

Considering the quantity of recovery and statement being made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II -cum- Special Judge (Excise), Sitamarhi in connection with G.O. Case No. 125 of 2019.
