The petitioners seek bail in connection with Excise P.S. Case No.1727 of 2025 registered for the offence under sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act.

As per the prosecution case, the recovery is of 198 liters of illicit liquor from 5 plastic bags. 4.

It has been submitted by the learned counsel for the petitioners that the petitioners are innocent and they have falsely been implicated in this case.

Learned counsel for the petitioners submits that the petitioners are ready to donate Rs.25,000/- in some charitable organization without accepting their guilt. He further

Considering the facts and circumstances of the case, this application is allowed.

Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise-II, Muzaffarpur / concerned court below, in connection with Excise P.S. Case No.1727 of 2025.

This is also subject to the condition that the petitioners shall deposit an amount of Rs.25,000/- in Ramakrishna Mission Ashrama, Bela, Muzaffarpur, and produce the receipt of the same before the Court below. The bail bonds of the petitioners shall be accepted after verifying the genuineness of the receipt produced by them.

As a condition of this order, the petitioners, after being released on bail, are directed to mark their attendance at Ahiyapur Police Station, District- Muzaffarpur on every Sunday of the month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioners.

As the petitioners claim to have clean antecedent, the Court below, before accepting the bail bonds of the petitioners is directed to verify the antecedent of the petitioners. The bail bonds of the petitioners shall only be accepted by the Court below if it is found that they have clean antecedent.
