Mr. Atul Chandra, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 24-01-2024 Heard Mr. Shanti Bhushan Singh, learned counsel appearing on behalf of the petitioner and Mr. Atul Chandra, learned APP appearing on behalf of the State.

2. The petitioner apprehends his arrest in connection with Gogri P.S. Case No. 263 of 2022 registered under Sections 323, 406, 409, 420, 120(B) of the Indian Penal Code.

3. As per the allegation made in the FIR, the informant established Jivan Bandhan Proficient Fund and the petitioner along with other accused persons named in the FIR had embezzled Rs.2,10,67,933/- from the informant, for which the informant sent notice but the accused persons including the petitioner did not given any satisfactory reply.

4. Considering the nature of allegation made in the

Patna High Court CR. MISC. No.1198 of 2024(2) dt.24-01-2024 2/2 FIR, as well as, the complaint made by the complainant, I am not inclined to grant pre-arrest bail to the petitioner.

7. The petitioner, if so advised, may file regular bail application before the Court below. The Court below in that case may call for case diary and pass order on merits.

8. Accordingly, the present bail application stands rejected.
