The petitioner in the present case is seeking regular bail in connection with Kotwa P.S. Case No.113 of 2019 registered for the offence punishable under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Learned counsel submits that there is a case and counter case and the dispute between the parties had taken place over a piece of land.

Learned APP has opposed the prayer for bail.

Considering the facts and circumstances of the case

No.79474 of 2019(2) dt.11-12-2019 2/3 wherein the submission of learned counsel for the petitioner is that the dispute between the parties had taken place over a piece of land and construction of house thereon in respect of which both the parties have lodged case and counter case against each other and so far as this petitioner is concerned, there is no allegation of causing assault against him, the petitioner has remained in custody since 07.09.2019, investigation against him is complete and that it is not the submission of learned counsel for the State that his release is likely to interfere in course of trial, let the petitioner above named be released on bail on furnishing bail bond of Rs.

15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Ixthcum-Special Judge, Excise, East Champaran, Motihari in connection with Kotwa P.S. Case No.113 of 2019, subject to the condition as laid down under Section 437 (3) Cr.P.C.
