The present application has been filed for modification of the order dated 20.08.2018 passed in Cr. Misc. No. 50928 of 2018 by which the petitioner was granted bail in connection with Laheri P.S. Case No. 123 of 2018 to the satisfaction of learned Chief Judicial Magistrate, Bihar Sharif and the petitioner was directed to surrender in the Court below within a period of six weeks and furnish bail bonds.

Learned counsel for the petitioner submits that inadvertently in the cause title of Cr. Misc. No. 50928 of 2018,

Patna High Court Cr.Misc. No.62628 of 2018(2) dt.10-10-2018 2/2 father's name of the petitioner is mentioned as "Dharampal Rai" in place of "Dharampal Sao" and due to which he could not surrender in the Court below well within time. It is prayed on behalf of the petitioner that further time may be extended so that the petitioner could surrender in the Court below and furnish bail bonds.

Considering the submissions made on behalf of the learned counsel for the petitioner and the grounds mentioned in the modification application, the same is allowed. Let in cause title of Cr. Misc. No. 50928 of 2018, father's name of the petitioner be read as "Dharampal Sao" in place of "Dharampal Rai". The period of surrender of the petitioner in the Court below is also extended for a further period of six weeks from the date of receipt/production of a copy of this order. The rest of the conditions stipulated in the order will be same. The order dated 20.08.2018 passed in Cr. Misc. No. 50928 of 2018 is modified to the extent as indicated above.
